These tools are provided for educational, informational, and self-reflection purposes.

Results may depend on information voluntarily provided by the user and may be affected by:

Assessment results do not constitute a professional diagnosis, clinical evaluation, legal determination, financial determination, or guarantee of any outcome.

Users remain responsible for how they interpret and use assessment results.

8. EDUCATIONAL, COACHING, CONSULTING, AND INFORMATIONAL SERVICES

FBS Consulting Solutions, LLC may provide educational programs, courses, training, workshops, coaching, consulting, business resources, career resources, relationship education, marketing services, artificial intelligence consulting, technology guidance, multimedia resources, and related services.

Unless expressly stated otherwise in a separate written agreement, these services are educational and informational in nature.

SERVICES WILL BE UNINTERRUPTED SERVICES WILL BE ERROR-FREE DEFECTS WILL ALWAYS BE CORRECTED INFORMATION WILL ALWAYS BE CURRENT OR ACCURATE SERVICES WILL MEET EVERY USER'S REQUIREMENTS THIRD-PARTY SERVICES WILL FUNCTION WITHOUT INTERRUPTION USE OF OUR SERVICES WILL PRODUCE A PARTICULAR RESULT

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

This preserves the broad warranty protection contained in Section 7 of your original Terms.

25. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FBS CONSULTING SOLUTIONS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF OUR WEBSITES, PRODUCTS, SERVICES, CONTENT, ASSESSMENTS, COURSES, COACHING, CONSULTING, THIRD-PARTY LINKS, OR DIGITAL MATERIALS.

Your original Terms already contained a broad limitation covering direct, indirect, punitive, special, exemplary, incidental, and consequential damages. That protection should remain.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FBS Consulting Solutions, LLC and its owners, officers, employees, contractors, affiliates, licensors, and agents from claims, liabilities, damages, losses, costs, and reasonable expenses arising from or related to:

27. CONSUMER RIGHTS

Your original Terms specifically included a California Civil Code Section 1789.3 consumer-rights notice, so retaining a California consumer section is appropriate.

28. DISPUTE RESOLUTION AND ARBITRATION

Except where prohibited by law or where another written agreement expressly provides otherwise, disputes, controversies, or claims arising from or relating to these Terms, our websites, products, or services may be submitted to binding arbitration.

Before initiating arbitration, the parties should make reasonable efforts to resolve the dispute informally.

Where arbitration applies, it may be administered under applicable rules of the American Arbitration Association or another mutually agreed arbitration provider.

Unless otherwise required by law or agreed in writing, arbitration shall occur in Columbia, South Carolina or may be conducted remotely where appropriate.

The arbitrator shall have authority to award remedies available under applicable law.

Judgment on an arbitration award may be entered in a court of competent jurisdiction.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief where necessary to protect intellectual property, confidential information, or other legal rights.

29. JURISDICTION AND VENUE

To the extent a dispute is not required to be arbitrated, and unless applicable law requires otherwise, the courts located in Richland County, South Carolina, and the applicable federal courts serving South Carolina shall have jurisdiction and venue over disputes arising from these Terms or our services.

30. GOVERNING LAW

These Terms shall be governed and construed according to the laws of the State of South Carolina, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent applicable, the United Nations Convention on Contracts for the International Sale of Goods is excluded.

This preserves the controlling-law concept in your original document.

31. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable where legally permissible.

If modification is not possible, the provision shall be severed.

The remaining provisions will remain in full force and effect.

The unenforceability of one provision will not affect the enforceability of the remainder of these Terms.

32. FORCE MAJEURE

FBS Consulting Solutions, LLC shall not be responsible for delay, interruption, or failure to perform caused by circumstances beyond our reasonable control.

Your original Terms already contain force-majeure language covering matters such as acts of God, military or civil authority, fire, riots, wars, embargoes, Internet disruption, hacker attacks, and communications failures.

33. MINORS AND AGE REQUIREMENTS

Unless otherwise stated, FBS Consulting Solutions, LLC websites, products, assessments, courses, coaching programs, consulting services, and other commercial services are intended primarily for adults.

Users under the age of 18 should use services only with appropriate parent or legal guardian permission where required by law.

Certain products, assessments, purchases, coaching engagements, consulting services, or contractual transactions may require users to be at least 18 years old.

Our handling of children's Personal Information is addressed in our Privacy Policy, including applicable Children's Online Privacy Protection Act ("COPPA") provisions.

The Disclaimer provides additional information concerning professional advice, educational content, results, third-party resources, business information, relationship information, artificial intelligence, and other limitations.

36. AFFILIATE DISCLOSURE

FBS Consulting Solutions, LLC may participate in affiliate or referral relationships.

Our separate Affiliate Disclaimer provides additional information regarding commissions, referrals, sponsorships, and other compensated relationships.

37. WAIVER

Failure by FBS Consulting Solutions, LLC to enforce any provision of these Terms will not constitute a waiver of that provision or of our right to enforce it later.

Any waiver must be authorized in writing to be effective.

38. ENTIRE AGREEMENT

These Terms of Use, together with our Privacy Policy, Disclaimer, Affiliate Disclaimer, applicable purchase terms, and any separate written agreements, constitute the applicable agreement governing use of our general websites and services.
